1. General

These terms apply to all purchases made through DABCE Shop and supplied by DABCE AB, org. no 559311-1122.

By placing an order, the customer accepts these Terms & Conditions.

DABCE Shop serves both private consumers and business customers in Sweden and internationally.

Unless otherwise agreed in writing, these Terms & Conditions shall prevail over any purchasing terms, standard terms or conditions provided by the customer.

2. Prices

All prices shown in DABCE Shop include 25% Swedish VAT unless otherwise stated. Prices exclude freight, transportation, packaging, installation, commissioning and startup costs unless otherwise stated.

DABCE AB reserves the right to modify prices, correct pricing errors, correct technical inaccuracies, update product information and adjust prices due to supplier costs, exchange rate fluctuations, taxes, duties or circumstances beyond the control of DABCE AB.

In the event of an obvious pricing error, DABCE AB reserves the right to cancel the order and refund any payment received.

Any applicable freight, transportation, packaging or delivery charges will be presented separately before the order is finalized.

Transportation for larger systems, customized solutions and project-specific equipment may be quoted separately unless otherwise stated in the quotation or order confirmation.

3. Products and Specifications

Product images, datasheets, specifications and descriptions are provided for guidance only.

DABCE AB reserves the right to modify components, materials, construction details and technical specifications without prior notice provided that the intended functionality of the product is not materially affected.

The customer is responsible for providing accurate information regarding water quality, flow rates, loads, intended application and other project-specific conditions. DABCE AB shall not be liable for errors, deficiencies or performance issues resulting from incorrect, incomplete or misleading information supplied by the customer.

Product performance and treatment results are influenced by incoming water quality, operating conditions, installation, maintenance and use. Unless expressly agreed in writing, DABCE AB does not guarantee that any product will meet specific regulatory requirements, drinking water standards or other customer-specific quality requirements.

4. Availability and Delivery

Stock availability information is preliminary.

If a product cannot be supplied after an order has been placed, DABCE AB reserves the right to cancel all or part of the order and refund any payment received.

DABCE AB shall not be liable for any indirect costs, losses or damages arising from delayed or failed delivery.

5. Payment

Payment shall be made using the payment methods available at checkout.

Title and ownership of delivered products shall remain with DABCE AB until full payment has been received.

6. Warranty Claims

Consumers are protected by applicable consumer legislation.

Business customers must report defects within a reasonable time after discovery.

7. Returns and Right of Withdrawal

Consumers have a 14-day right of withdrawal in accordance with applicable distance selling legislation.

To qualify for a return, the product must be returned in substantially unchanged condition, complete with accessories, documentation and original packaging where applicable.

The right of withdrawal applies only to standard stock products supplied without customer-specific modifications.

The right of withdrawal does not apply to made-to-order products, customized systems, project-specific solutions, products manufactured according to customer specifications, products modified at the customer's request, or systems assembled, configured, programmed or otherwise processed specifically for the customer.

This includes, but is not limited to, ModuPure™ systems, OWTS™ systems, custom filter packages, process equipment, water treatment modules, automation solutions and other products configured or assembled according to customer requirements.

For products covered by the right of withdrawal, the customer is responsible for return shipping unless otherwise agreed in writing.

Refunds will be issued after the returned product has been received, inspected and approved by DABCE AB.

8. Limitation of Liability

DABCE AB shall not be liable for indirect losses, production downtime, loss of profit, loss of revenue or any consequential damages arising from the use of products or systems supplied by DABCE AB.

DABCE AB shall not be liable for damages resulting from improper installation, improper operation, insufficient maintenance, unauthorized modifications, user error or use contrary to product documentation or intended application.

DABCE AB shall not be liable for water damage, flooding, leakage, corrosion damage, freeze damage, damage to buildings, utilities, piping systems or other property occurring in connection with the installation or use of products supplied by DABCE AB.

Products must be installed in accordance with applicable laws, regulations, industry standards and good engineering practice. The customer is responsible for ensuring that appropriate shut-off valves, drainage systems, freeze protection, leak protection and other safety measures are installed where required.

If installation is performed by a third party, DABCE AB shall not be responsible for the installation work or for any damages, faults or deficiencies arising from such work.

Unless otherwise agreed in writing, installation, commissioning, training, process optimization, regulatory assistance and ongoing support are not included in the product delivery.

The customer is responsible for ensuring that the product is used in compliance with applicable laws, regulations and authority requirements in the country or jurisdiction where the product is installed or operated.

Under no circumstances shall DABCE AB's total liability exceed the amount paid by the customer for the specific product or delivery giving rise to the claim.

The customer is responsible for ensuring that chemicals are stored, handled, dosed and used in accordance with applicable legislation, safety data sheets, product labeling and relevant safety regulations.

DABCE AB shall not be liable for damage, personal injury, environmental damage or operational disturbances resulting from improper storage, handling or use of chemicals.

Products generating ozone may only be operated in accordance with the product documentation and safety instructions. The customer is responsible for ensuring that adequate ventilation, occupational safety measures and protective equipment are provided where required.

The performance of UV systems depends on proper installation, operation, maintenance and the regular replacement of consumable components such as UV lamps and quartz sleeves. DABCE AB shall not be responsible for reduced performance resulting from insufficient maintenance.

Filter media, UV lamps, quartz sleeves, electrodes, membranes, seals, gaskets and other consumable or wear components are considered consumables and are not covered by warranty except as required by mandatory law.

The customer is responsible for ensuring that importation, installation, use and operation of the product are permitted under the applicable laws and regulations of the destination country or jurisdiction.

Data generated by products may be stored, processed and presented within DABCE Cloud or related systems in accordance with the applicable privacy policy and data protection policy in force at the time.

The customer is responsible for arranging analysis of both incoming and treated water to the extent necessary for the intended use of the water.

9. Intellectual Property Rights

All intellectual property rights relating to products, software, drawings, documentation, designs, process descriptions, trademarks and technical solutions remain the property of DABCE AB or its licensors.

The customer may not, without prior written consent, copy, reproduce, distribute, disassemble, reverse engineer or otherwise attempt to recreate the design, software or technical solutions of any product supplied by DABCE AB.

10. Force Majeure

Force majeure includes, but is not limited to, war, pandemics, natural disasters, cyberattacks, governmental actions, trade restrictions, energy shortages, transportation disruptions, labor disputes, supplier failures and shortages of raw materials or components.

DABCE AB shall not be liable for delays, failures or other events caused by circumstances beyond its reasonable control.

11. Governing Law

These terms shall be governed by Swedish law.
